Authorize Electric Services Agreement with J5, LLC

Authorizes the Electric Services Agreement between the City of Piqua and J5, LLC covering electric service to the Project Klondike datacenter site. Passed 3–1 with Commissioner Simmons voting nay — the first recorded dissenting vote on a project-related action in this timeline. The underlying Electric Services Agreement was signed separately: by J5's Pamela Gregorski on July 22, 2026 and by the City's Rick Byron on August 3, 2026.

Motion offered by Commissioner DeBrosse, seconded by Commissioner Walker. Commissioner Wead was excused. Section 3 of the resolution states it "shall take effect and be in force at the earliest date permitted by law" — standard non-emergency effective-date language. Unlike Ordinance O-18-25 (Nov 3, 2025), this resolution was NOT passed as an emergency and carries no emergency declaration or justification.
